IN INDIANAPOLIS, ASSAULT AND BATTERY IS NOT A CRIME

Over two years ago I was attacked by three men while taking my mother into her house. I was hit in the face, knocked to the ground, and kicked in the ribs. I sustained black eyes, lacerations, and three broken ribs. One of the ribs lodged in my liver. Had it penetrated my lung or kidney I would have been dead.

The Indianapolis Police Department responded quickly, but the Marion County Prosecutor thinks this is a misdomeanor, like a parking ticket. His staff only charged one of the three attackers. After three continuances it went to court. I cancelled a business trip to be in court. The case was dismissed before being heard because the deputy prosecutor failed to get the police photographs. I was promised that the case would be refiled. Despite numerous calls to the prosecutor's office nothing has been done. We have now passed the statute of limitations, so nothing will be done.

The results for me have been:
  • I had to sleep with my arms over a high backed chair for two months to relieve pressure and pain;
  • I could not sleep more than two hours at a time for a few more months because every position was painful;
  • I was trying to replace my biggest client (Samsung) after the end of my consulting arrangement, and had to go to interviews with black eyes. My eyes remained very dark for almost a year, limiting my chances to do business.
Because of my inability to work, this situation has been devastating for my family. During this time the prosecutor's staff has been consistently unresponsive, rude, and disorganized. We need a prosecutor who is responsive to assault and battery, not just interested in high profile cases.

It happens that the attackers were active supporters of the current Marion County prosecutor.
